Rackast, End User License Agreement (EULA)

1. Parties
This EULA is between Szegi Roland Attila E.V. (the "Licensor") and the individual or entity using the Rackast software (the "User"). The software is sold by Polar as Merchant of Record; the right to use it is granted under this EULA.
2. License grant
The Licensor grants a non exclusive, non transferable, revocable license to install and use Rackast for the duration of a valid subscription on up to 2 devices at a time (license key based activation). You may deactivate a device yourself in the Polar customer portal to activate another.
3. Restrictions
You may not: (a) reverse engineer, decompile or disassemble the software except to the extent the law mandatorily permits; (b) rent, lease, sublicense or redistribute the software; (c) remove copyright notices; (d) circumvent the license or activation mechanism; (e) use the software for unlawful purposes.
4. Ownership
The software and all intellectual property rights remain with the Licensor. You acquire the right to use the software as set out in this EULA, not ownership of it.
5. Updates
The Licensor may release updates from time to time as part of the subscription. Updates are covered by this EULA unless separate terms accompany them.
6. Data and local processing
Rackast performs recording, editing and AI caption transcription (whisper.cpp based) locally on your device. Your video and audio content are not uploaded to the Licensor. Details are in the Privacy Policy.
7. Warranty and conformity
The software is provided "as is" to the maximum extent permitted by law. This limitation does not affect the EU digital content conformity requirements (Directive (EU) 2019/770), which apply mandatorily to consumers.
8. Limitation of liability
The Licensor is not liable for indirect, consequential, special or incidental damages, lost profits or data loss to the extent permitted by law. The Licensor's total liability shall not exceed the amount you paid for the product in the 12 months preceding the claim. These limitations do not apply to damage caused intentionally or by gross negligence, to death or personal injury, or to any liability that cannot be limited by law.
9. Termination
The license terminates when the subscription expires or is cancelled, or upon a material breach of this EULA. On termination you must cease using the software.
10. Governing law
Hungarian law applies, without prejudice to mandatory consumer protection rules.
